These Terms of Use govern the use of NetworkCore (a desktop application for managing GPON OLTs and its subscriber portal), provided by Vitrion Serviços e Treinamentos em TI Ltda – ME ("we"), a company registered under Brazilian taxpayer ID (CNPJ) 50.071.838/0001-44, headquartered at Rua Gilberto Freire, 12, Vila Maria, Bandeirantes/PR, Brazil, ZIP 86360-205. By creating an account, subscribing to a plan, or using the software, you (the "Customer") agree to these Terms.
1. The service
NetworkCore is software that runs locally on the Customer's computer for inventory, monitoring, and operation of OLTs. The portal (this site) is used to manage your account, subscription, and licenses. The Customer's network inventory and data are stored on their own computer, not on our servers.
2. Account
The Customer is responsible for keeping their credentials confidential and for all activity carried out under their account. Registration data must be truthful and kept up to date.
3. License to use
- We grant a non-exclusive license to use the software, per instance (computer), according to the contracted plan. The OLTs managed per instance are unlimited.
- The license is bound to the machine identifier (fingerprint) and validated by digital signature. Bypassing, defrauding, or removing the licensing mechanisms is prohibited.
- Switching machines: the license is non-transferable to third parties (resale and sublicensing are prohibited), but the Customer themselves may transfer the license to a new computer (e.g., hardware swap, reinstall) via the portal, up to 3 (three) times per license. A transfer deactivates the previous machine. In legitimate cases beyond this limit (hardware failure, theft), support may grant additional transfers.
- Reverse engineering or redistribution of the software is prohibited, except with express authorization. The software and all intellectual property rights remain with Vitrion.
4. Plans, payment, and renewal
- The current plans and prices are those shown on the portal. Billing is handled by a third-party payment provider (PIX, bank slip, or card).
- Perpetual license (one-time payment): some plans (e.g., Individual) are sold as a one-time payment, granting a perpetual license to use the acquired version: the software does not expire and works offline, with no periodic validation required. The payment includes 1 (one) year of support and updates; after that period the software keeps working, only the right to support/updates ends (renewable separately, if offered).
- Recurring subscriptions (where applicable) renew automatically at the end of each cycle (monthly or yearly) until cancellation; non-payment may suspend access to paid features after the grace period.
- Applicable taxes may be added to the amounts.
5. Cancellation and refund
- The Customer may cancel the subscription at any time via the portal. Cancellation stops future charges; access is kept until the end of the period already paid for.
- Right of withdrawal (art. 49 of the Brazilian Consumer Code – CDC): for purchases made online, the Customer may withdraw within 7 (seven) days of contracting, with a refund of amounts paid in the period.
- Apart from that case, amounts for periods already used are non-refundable, unless otherwise required by law.
6. Acceptable use
The Customer agrees not to use the software for unlawful purposes, not to attempt to circumvent licensing, not to overload our infrastructure, and not to access third-party resources without authorization. Write operations on network equipment (OLTs) are the Customer's sole responsibility.
7. Warranties and liability
- The software is provided "as is". We do not guarantee uninterrupted operation of the portal nor fitness for a particular purpose.
- The Customer is solely responsible for operating their network and for the commands run on their equipment. Caution is advised in production environments.
- To the maximum extent permitted by law, we are not liable for indirect damages, lost profits, or unavailability of the Customer's network.
8. Suspension and termination
We may suspend or terminate access in case of violation of these Terms, fraud, or non-payment, without prejudice to applicable measures.
9. Changes
We may update these Terms. Relevant changes will be communicated via the portal or by email. Continued use after they take effect implies agreement.
10. Governing law and venue
These Terms are governed by the laws of Brazil. The courts of the district of Bandeirantes/PR, Brazil are elected as the venue, except where a different legal jurisdiction applies (e.g., the consumer's venue).
